Reopenings and Appeals
Applying for a reopening
If you were convicted of a Part 1 Certificate of Offence, you may be eligible to apply for a reopening by:
- Completing a reopening application / affidavit
- Filing the completed application / affidavit with the court office
This must be done within 15 days of being made aware of the conviction
Filing an appeal
To appeal your conviction and / or sentence you must do so within 30 days of the conviction date.
You must pay your fine in full before your appeal can proceed and file a Notice of Appeal with the Ontario Court of Justice, Criminal Court Division

Filing an appeal after 30 days
If you don't file an appeal within 30 days, you may apply for an extension of time to appeal under Section 85 of the Provincial Offences Act.
Your application(s) will be addressed before a Provincial Court Judge who will consider whether or not to grant your request.

If you're not able to pay the fine, you must apply to file an appeal without paying the fine.
