Regional Official Plan Amendment Application (ROPA-21-0004)
Stone Eagle Winery, Town of Niagara-on-the-Lake
In accordance with the provisions of the Planning Act (under Section 22), this notice is to advise that NPG Planning Solutions Inc., on behalf of Stone Eagle Property Corp./2775696 Ontario Inc., has submitted application for a Regional Official Plan Amendment to permit a new private sanitary connection outside of the Urban Area Boundary.
The proposed amendment affects lands legally described as Lots 43 and 44 and Part of Lots 46 and 47, Plan M-11, located at the northwest corner of Niven Road and Niagara Stone Road within the Town of Niagara-on-the-Lake.
Purpose and effect of the application
The Regional Official Plan designates the lands as Unique Agricultural Area. The proposed Regional Official Plan Amendment will consist of text change to add a provision to Section 13 (Site Specific Policies) of the Regional Official Plan in order to permit a new private sanitary connection to the subject lands.
The Planning Act requires that all complete applications be processed. The application has been circulated to prescribed agencies for technical review. No decision by Regional Council has been made regarding this application.
A concurrent application for a local Zoning By-law Amendment has also been submitted by the applicant to the Town of Niagara-on-the-Lake (Town File No. ZBA-11-2021).
The local Zoning By-law Amendment proposes site specific provisions for an Estate Winery and secondary uses, including the retail of wine, indoor and outdoor hospitality areas, restaurant/function room, kitchen and dry food services with maximum floor areas for the uses, an increased building height and parking requirements.
The Zoning By-law Amendment and Regional Official Plan Amendment will be processed concurrently.
An open house will be hosted by the Town of Niagara-on-the-Lake and held on March 2, 2022, for the purpose of giving the public an opportunity to review and ask questions about the proposed Amendments and supporting information.
Both Town and Niagara Region staff will be in attendance to ensure that information respective to each amendment is gathered and considered. More information on registration for the open house can be found in the Town’s Notice.
A Regional Statutory Public Meeting will be held at a Regional Planning and Economic Development Committee meeting in Spring 2022 as per Planning Act requirements. Formal notice of the Public Meeting will be sent once a date has been established.
The public meeting is an opportunity for the public to make representations in respect of the proposed amendment.
Have your say
Your feedback on the proposed Regional Official Plan Amendment is welcomed and encouraged. Any written comments either by mail or email submitted to the Region will be included in the staff recommendation report prepared for Council consideration and become part of the public record.
A separate notice will be provided by the Region to inform you of the date of the Regional public meeting for the Regional Official Plan Amendment to permit the sanitary service connection.

ii. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Niagara Region before the proposed Regional Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
iii. Any personal information is collected under the authority of the Planning Act, R.S.O. 1990, c. P. 13 and may be used in an appendix of a staff report, published in the meeting agenda, delegation list and/or the minutes of the public meeting and made part of the public record. The Region collects this information for the purposes of making informed decisions on the relevant issues and to notify interested parties of Council’s decisions. It may also be used to serve notice of an Ontario Land Tribunal hearing. Information collected, used and disclosed is in accordance the Municipal Freedom of Information and Protection of Privacy Act.
